Legal Question in Employment Law in Virginia

In 2005 I did not qualify for vacation pay so to take a week off I saved up 4 holidays and a personal day. In 2007 I received 2 weeks vacation and they are saying they have to take one week away because on my check it was marked that I was payed vacation in 2005. If I did not qualify how could they have payed me for vacation and can they legally keep that from me?

Why not take the matter up with HR or payroll? Virginia employers are under no obligation to provide their employees with paid vacations unless required to do so under an employment contract.
