Legal Question in Employment Law in Virginia

Paycheck Withholding

My company signed and approved my incomplete timecard (35 out of 80 hours) and is now withholding the 45 hours until my next pay period.

I think I am an exempt employee, I don't get paid for any hours over 80 (every 2 weeks). Although apparently my pay gets docked for any hours under 80.

Is it legal for my company to withhold (for 15 days) 45 hours of pay because I was late signing my timecard (by 1 day)?

My company is located in VA, but I work and pay taxes in CO.

Re: Paycheck Withholding

You should check with a Colorado attorney familiar with that state's labor laws or make inquiry yourself to the particular Colorado state agency which regulates wage and hour matters

in Colorado.
