Legal Question in Employment Law in Virginia
Pension Snafu
A year after receiving my pension, the plan administrator now advises that they applied the wrong factors and paid out $11,000 more than appropriate. They now want it back and if not paid they will substract $60.00 a month from my pension check over my life expectancy. My pension was split between a cash out and a lifetime income. It is the cashout portion that paid out the so called extra $11,000. Can the plan trustee or plan adminstrator deduct $60.00 a month if I do not settle up with them based on their schedule?

Re: Pension Snafu
I don't see why not (if in fact you received $11K that you were not entitled to.)
