Legal Question in Employment Law in Virginia
Post hiring job description change
I work in a public school as an instructional assistant with special education. I have been employed for 11 years. My colleagues and I are now being asked to take training for toileting, lifting (up to 150 pounds) and feeding of severely handicapped students. This has never been asked of us until now. They are not considering who is comfortable with this issue and is willing but are asking only the assistants to train for this. (A 30 minute video is what the ''training'' will consist of. We were told that in the past couple of months our job description had been rewritten to include the above mentioned duties. I am uncomfortable with this issue and physically not capable of the lifting. I wanted to know how a job description can be changed so drastically without our knowledge. Many of us are not willing to do this. I read a few other responses about various areas in Virginia and saw that this is an ''employment at will jurisdiction.'' Does that mean they can do whatever they want when they want with your job description. In this case we do not receive contracts. We only receive letters stating salary each year. Thank you!

Are you civil service or a do you have a union? If yes to either or both you may have recourse.
