Legal Question in Employment Law in Virginia

I received a check today in the mail from my old job and the check is dated April 21, 2009 and the check also saids void after 60 days. I also, received my check teared from the edges, meaning someone had open it. So I was wondering if what they did illegal to do? And do I have the right to tell them to send me a new check with the same amount?

Of course, you have a "right" to request a replacement check for the now void draft just received from your old employer. Unfortunately, however, you cannot have complete assurance that this former employer will comply with your request until you actually receive the replacement check and it clears the bank.
