Legal Question in Employment Law in Virginia

Recently I signed a contract with a local doctor to develop a piece of software. He agreed to wait six months for this project. My girlfriend was under his employ for approximately 5 months - she told him what I do and he asked to meet, her involvement was nothing more. About a month in (a few days ago) said doctor deliberately ignores multiple emails, then leaves his office before a meeting he scheduled, then emails me demanding I send him his USB flash drive which he wanted me to use for "security reasons" with my girlfriend. I didn't, and still don't believe she should be in the middle of our business and decided I'd take it to him myself. The next day, I wake up to a phone call saying that the doctor was holding my girlfriend's check ransom for this USB drive. Then once he gets the USB drive, he fires her.

The DoL says get my own lawyer and tell her to file for unemployment. My question is, I guess, what should I do? Lawyers are expensive, and while this seems to me blatantly wrong in every aspect, I've come to find this doesn't always matter in court.

So what are your (not your girlfriend's) provable damages under this contract?

If they're $5K or less, you could sue this doctor in small claims court without

the concern of having to retain counsel to represent you.
