Legal Question in Employment Law in Virginia

Reference checks

I was wanting to know what exactly by law can a previous employer tell a potential employer about you and/or your work history? I have been having problems with my most recent employer, I left the co because I kept getting the run around about FMLA (told by one I could take it, told by another I couldn't). I was out alot due to a medical problem that was documented as well as justified by my MD. I have a feeling that they are giving me a bad reference due to me being out alot because of this medical problem. Which in turn is preventing me from getting another job. Can they do this?

Re: Reference checks

You have to have more than a feeling that your

former employer is deliberately giving bad references(essentially, intentionally false information or in reckless disregard of the truth)on you to prospective employers who may

be interested in hiring you.

You must have credible evidence.
