Legal Question in Employment Law in Virginia

Release Agreement

I was terminated (with no legitimate known cause) and asked to sign a release agreement in order to receive severance pay. If my severance check differs from the agreement signed is the agreement still binding?

Re: Release Agreement

The agreement could still be binding

unless there was a material default in one or more of its terms by at least one of the parties to the agreement.

Whether or not the shortfall in the expected severance pay would qualify as such would likely depend upon

the amount of the disparity between what was promised in the agreement and what you actually received in the severance check.
