Legal Question in Employment Law in Virginia

Relocation reimbursement

I was relocated by an employer and left the position after 6 weeks. The

employer notified me after my resignation that I was responsible for the

relocation costs because I did not stay for 12 months. I was never

notified of this policy either in writing or verbally at any time prior to my

accepting the position or before the actual move. The offer letter from

the employer stated that they would pay the relocation costs and 60

days of temporary housing - nothing about a reimbursement if I did not

stay for the year. The Employee Handbooks I received did not contain

the relocation policy either. I have now been served with a Warrant in

Debt and really do not know how to proceed. I am 61 years old, not

working, and do not have the $10,000 + that they are looking for. I

appreciate any assistance.

Re: Relocation reimbursement

You have already articulated what should be an effective defense to this ex-employer's claim for reimbursement. You should, therefore, incorporate

it in your Answer and Grounds of Defense which is the name of the responsive pleading which must now be prepared and filed in your behalf as the defendant in this matter.
