Legal Question in Employment Law in Virginia

Reversal of Direct Deposit (Payroll)

I left my old company for a better position. I did not give notice and monday of this week was last day. I had a direct deposit of $1183 (payroll) that posted to my account last Friday. I checked my account yesterday and everything was fine. I checked it this morning and Feld has taken out my payroll money to put toward my tuition I owed. However, they never allowed me to followw the repayment plan below. that is FELDs policy. Can you help?

Felds Policy states this:

If an Associate is required to repay Feld Entertainment for reimbursed coursework, the following schedule will be followed

Full repayment on the last day of employment

Or, 1/3 repayment due 30 days after last day of employment, plus 1/3 repayment due 60 days after last day of employment, plus full payment of the remaining balance due 90 days after last day of employment.

If payment is not received at the end of the payment period, and no practicable reason is given for the delay, the unpaid balance will be turned over to a collection agency.

Re: Reversal of Direct Deposit (Payroll)

Why not call them up(HR or whoever)and make them fully aware of your objection(assuming that you haven't already done so)?

Perhaps, the company requires some prior notice from the departing employee and if they don't receive it they just appropriate the "whole enchilada", so to speak, as apparently was done in your case.
