Legal Question in Employment Law in Virginia

Hi,

I have been searching throughout the legal websites and cannot seem to find a specific answer to a question. If someone is administratively suspended, can an employer re-hire or open hire for your position while you are on administrative suspension? This is a hypothetical situation, I am in a class and while my present research is finding administrative suspension w/DUI, it does not touch upon this situation. Any place markers or websites you can suggest would be helpful.

Yes, in the absence of an enforceable contract that would prohibit such activity

on the part of the employer, I know of no reason as to way an employer in a so-called employment at will jurisdiction such as the Commonwealth of Virginia could not do exactly that as has been described.
