Legal Question in Employment Law in Virginia

Security check-time worked

I am a civilian contractor who works on a military base. Sometimes the security check to get on base takes one minute, sometimes the line takes ten minutes, and if we have an incident where the security level is raised, it could take hours (search all or many cars even with proper ID).

No one has challenged us on hours worked, but since we have zero control over the time we are in line, could that be considered work hours? We were as close as we could get to our office at the proper time.

Re: Security check-time worked

If you're a civilian contractor with the military, then the contract which you're working under would determine whether you could claim compensation for the kind of time you have described spent in a search queue.

I would surmise that this is something that would most likely have to be negotiated and that it is

unlikely that there is a provision for such compensation in your current contract.
