I am seeking legal advice on a case I am considering
persuing.I am an employee for a franchise owner who has been late paying
me since the begining of my employment in october. When the issue of my
non payment for worked hours came up he informed me that he was not
going to deal with it I would need to work it out with my manager who
reports my hours. I tried on many occasions to do this with her but she
was unwilling to report to me what hours and days she had recorded that
I worked. The part that has me in a bind is that my employer told me his
computer was broken so he wouldnt be able to pay me via check so I had
to accept cash as payment (still taking out for taxes) and often I would
not get paid for days and sometimes weeks after my payday. this time was
too much...I was due to be paid on December 21st and tried on many
occasions to collect my payment only to be ignored by my employer. I was
then informed I would be paid on January 1st 2013 I was not paid. I
spoke with my manager who said she was submiting a time sheet of 62.03
hours when the hours i worked equaled 85.3 and she then told me when I
corrected her and told her i have messages from her confirming I worked
more days than that, that she was submitting the 62.3 hours and I either
take it or leave it. I had to take out payday loans to pay the bills
that were late due to non payment from my employer. and I am now
obviously without a job and without my money. I am seeking legal advice
to find out what my options are in dealing with my now former employer

Sue the SOB in your local small claims court for the amount of your still unpaid
(but earned) wages + court costs.
