Legal Question in Employment Law in Virginia
Slander
This is in reference to my son, who was dating a girl, and after he broke up with her, she called his place of employment, and accused him of stealing from the company for her, which of course he didn't. She did it our of spite being that he had left her. Actually he works for an independent janitorial contractor. A week and a half ago, he received a call from his supervisor that he was not to report to work that night. He was really upset because he didn't know what had happened and his supervisor didn't tell him anything. He got a call the next day and was told he had a meeting to attend. He got there and was told why he was not to enter the building he worked in anymore. They told him that they don't believe this girl, but he still cannot work in the same building. He is working in another building across the street. What are the steps I/we need to take against this company, and this girl. I would appreciate any information I can get. I don't want to wait too long.
Thank you.

Re: Slander
With respect to the company, I see no basis for any cause of action that would be provable in a court of law based upon the fact scenario which you have propounded.
With respect to the girl, your son might have an
action for defamation (slander), although the elements for this kind of case which one must prove can be surprisingly difficult to establish. However, even if your son were to secure a judgment against her, chances are that this girl has no assets either to levy against or attach. In other words, she's what the law refers to as "judgment proof."
Bottom line recommendation: Better forget about it.
