Legal Question in Employment Law in Virginia

Speeding lised as Misdemeanor

I was doing 100 in 55 and was found guilty and is now listed as misdemeanor. It has been 4 years now and wanted to know if there was anyway this could stop me from getting an employment where they asked me about my past 3 years of driving. And if there was any way I could get this off my driving record?

Re: Speeding lised as Misdemeanor

Whether you'll ever get your record of conviction for reckless driving off your Virginia DMV record will be up to the DMV. However, one thing is for certain: You'll never get it off your criminal record as reckless driving in the Commonwealth is a Class 1 misdemeanor which cannot be expunged.

Whether your record of the above conviction would be enough to deter some employers from hiring you, the answer, unfortunately, is yes,

in these tumultuous times, it could be.

However, if all a prospective employer is asking about is your driving record for the last three years, you, of course would not be under any obligation to disclose anything that goes beyond this particular time period.
