Legal Question in Employment Law in Virginia

Last summer, I worked at the floor installing company in Alexandria City School renovation project as a helper. I was told when I hired in that I was paid a fixed amount of money,$130.00, for working on workdays.I worked 12 hours a day and 6 days week . But did not receive overtime compensation.

Can I sue the employer for the unpaid overtime wages?

Only if you were classified as an hourly compensated employee who worked

in excess of 40 hours in any given week of the period under consideration.
