Legal Question in Employment Law in Virginia

I have to go in for surgery and I have enough sick pay to cover my time I will be out of the office, but my employer is forcing me to sign up for FMLA. They say if I don't sign up and my surgery turns for the worst, and I need more time off, I will be terminated. Is this lawful?

Yes, I would surmise that it is unless you happen to be working under the

protection of an enforceable contract (not likely) that would prohibit such action

on the part of your employer.
