Legal Question in Employment Law in Virginia

terminated during long term disability

I am about to be released to return to work after a long-term disability. My LTD nurse contacted my employer and was told my position was over when I opted not to accept COBRA benefits. I've not received any notice of termination. I called my district manager directly and he said there is no work for me. Can they do this? I live in VA, worked in MD and corporate offices are located in IL.

Re: terminated during long term disability

Yes, they can (and apparently already have)with impunity unless by some chance you were employed under a contract which offers protection against such action by your employer.
