Terminating a daycare contract
My day care provider was facing 25 days in jail so i had to find another provider so I wouldn't lose any time from work for 25 days waiting for her to get out. When she went to court, the judge stated she had to attend classes for a dui she was convicted of and if she didn't complete the classes, she would have to complete the 25 days in jail. Now, she's stating I'm in breach of contract because she ended up not going to jail so there is no ground for me not giving her a written notice terminating the contract with her. She's now saying I owe her for the time she HAS NOT been watching my children, even though, she was clearly facing jail time. Can I fight this in court?

Yes, of course, and if your defense is correctly and credibly presented, you should prevail(in my opinion).
