unemployment benefits
I have worked for an employer for 3 years 3 months. I was discharged because of poor performance. When I tried to claim unemployment benefits I received a letter from the VA unemployment office stating that a fact finding interview needed to be conducted to determine whether or not I was discharged for misconduct. While I worked at this company I was never accused of any type of misconduct and as stated above I was discharged for poor performance.
My question is can I be denied unemployment benefits for misconduct even if I was never accused of misconduct during the 3 plus years I worked for my employer.

Only if the misconduct can be proven by credible evidence.
