Legal Question in Employment Law in Virginia

Unemployment?

March 9, 2009 I was involved in an automobile accident leaving me unable to work due to neck and back injuries. Since then I have been out on extended FMLA and personal leave from my work. Work policy is after 90 days of personal leave they no longer guarantee my job position, however they guarantee employment. I just got a call today from my personnel manager. He told me that next week they are posting jobs and that if I don't sign up for one I will no longer be employed. The day of sign ups I am having a procedure done on my back and will not be able to be there. Even if I did sign up for a position I could not perform it due to my back injury which would lead to termination. My question is if I cannot sign up for a position could I still get unemployment when they let me go or would it seem like I quit?

Re: Unemployment?

If you're let go under these circumstances, why not apply for unemployment benefits and see what happens?
