Unfair HR Practices

I have worked for a company for 13 years. Our staff is Temp to hire. Managers are required to interview, administer testing to and evaluate candidates for positions that are filled through an off-site temp service. One candidate is alleging discrimination based on a ''promise'' of a position from a suboridinate. There is no formal written policy for these Manager's to follow, this protocol is not in their job description...Corporate HR did not launch the investigation until 3 days after the next level Supervisor had already confused everyone involved. Is this all legal?
