Legal Question in Employment Law in Virginia

Vacation and Sick Leave Policies

We currently have a vacation policy allowing an employee to accrue up to 160 hours of vacation. Can we legally chance this for existing employees to 80 hours accrued? We also pay all accured vacation time at termination and one half of accrued sick leave. Can we change this policy for existing employees to where we do not pay any accrued vacation or sick leave at termination?

Re: Vacation and Sick Leave Policies

Assuming that your company's vacation and sick leave policies are not covered by a contract or collective bargaining type agreeement, then you can change them or even eliminate such employee benefits at any time since there is no legal requirement in the Commonwealth that employers must provide sick and/or vacation leave or compensation in lieu thereof to their employees.
