Legal Question in Employment Law in Virginia
Voluntary layoffs and severance packages
A quick question about resignations, layoffs, and severance packages.
About 3 weeks ago I submitted my 2 week notice at my old company. I knew a big consolidation of departments was coming, most likely resulting in layoffs. My last day there was 9/16.
On 9/21 the result of the meeting was finally disclosed and a decision was made to layoff about 25% of the IT staff. All the affected staff will get a 60 day notice and pay for 1 week per year of service as a severance package. The kicker is they are accepting voluntary resignations also, with the same sort of package.
Obviously my timing was bad. Had I waited a bit longer to resign I would've been eligible for the severance. Do I have any recourse as far as getting the same severance package as other voluntary resignations? The sum in question is several thousand dollars.
Thanks for your help.

Re: Voluntary layoffs and severance packages
If by recourse, you mean a legal basis to make
a claim for this severance compensation, the answer most affirmatively is no, you don't.
