Legal Question in Employment Law in Virginia
Witholding Final Paycheck to recoup relocation expenses
Can my company keep my final paycheck to pay for relocation expenses even if the relocation was not completed. I was assualted at work by an employee resulting in 8 stiches to the eye and hip problems. 3 weeks later I was threatend by a manager with pyhsical violence. Upon telling my boss that this was unacceptable - I was demoted and relocated. The manager still works for the company. Due to the demotion I could no longer work for the company and gave them notice. They are trying to hold final paycheck to recoup relocation expenses. I would not be leaving the company except for the violence that I have expereinced and the resulting demotion. There is a signed relocation agreeemnt. Do I have a case based on any or all of the merits above?

Why not file your claim with small claims court for less than $40 and find out?
