i work at a car wash we are paid $40aday plus tips, is that suppose to equal out to be minium wage?

Yes, in the Commonwealth it should "equal out" to at least $290.00 per week

per worker or $15,080.00 per year. (This assumes that each worker earns at least $30.00 or more in tips per month.)

The current minimum wage in Virginia is currently apparently the same as the federal minimum of $7.25 per hour.
