Legal Question in Employment Law in Virginia

hi , i worked as a independent contractor for a consulting firm In VA from nov 28th 2010 - Dec 31st 2010. i took the unpaid vacation from jan1st - jan14th and during the vacation i decided to quit the job.

so called my employer and told him that i am quitting the job and my last day would be dec 31st.

Now he is not paying me for the entire month of December. All he paid me is for 3days in the month of november.

i can't go to the VA department of labor because i am 1099 contractor.

what is my next step.

Sue the SOB in small claims court for what you haven't been paid.
