Legal Question in Employment Law in Virginia

workers compensation insurane

My corporation sells and installs home furnishings to the US Government. It has 6 Territory Managers. Each of their territories spans several states. Some have many employees, one only has 1 employee. How do I know if they need workers comp insurance or not? What is my liability if they do not have it and one of their employees gets injured?

Re: workers compensation insurane

You must determine in each and every state in

which your company is doing business what the applicable Worker's Compensation laws are and how they relate to your enterprise.

In Virgfinia, these laws are found under Title

65 of the Code of Virginia. There is a presumption

that employers and employees have agreed to belong to the worker's compensation system and to pay and accept payment for injuries and/or death incurred by employees during the course of their employment.

Your liability as a company for not carrying the required insurance is also detailed in the

Worker's Compensation statutes, which may vary by state.
