Legal Question in Employment Law in Virginia
Possible Wrongful Termination
I have been a retail clerk for nearly 20 years.
One night, a employee had broken the company protocol by putting meat into a box and just labeling the box as a whole. It is against company policy because the contents of the box cannot be seen when its inside a box.
I asked the meat manager about the box. I actually only said, ''About the box.''
Before I could complete the question, he went off on a threatening cursing tirade. I lost control when he started accusing me of infidelity and insulting my family. I tried to throw the contents of my soda pop can onto him. A few drops of soda landed on his face.
Days later, a company investigator questioned me. I am not sure if he recorded me or not, but he did ask me to answer some questions. I asked my son to sit in through the questioning but the investigator said it was against company policy.
I am suspended from work, and they said they will hand down the decision this week or next.
When should I start seeking representation? Should I not sign anything from this point? Is my pouring of soda a grounds for termination regardless of cause?
Thanks,
S

Re: Possible Wrongful Termination
As to the outcome of this matter, much will depend upon whether or not you have been working under the protection of a contract or collective bargaining type of agreement. If not, you could possibly be terminated, leaving you without recourse or remedy.
