Authorised occupant refuses to leave
About 16 months ago, a priest who has been a family friend, showed up on my mother's doorstep. She thought he was just visiting. In July of 2007 I brought my mom to live with me in NH due to progressing Alzheimer's. The priest asked if he could stay. I gave him permission to stay thinking that it would be only until he was relocated to another parish. Come to find out he has been suspended from the priesthood. I need to sell my mom's home and he is refusing to leave. He has paid $450.00 on 7 occassions to cover utilities, but no rent and there is no written agreement. The police have told me that since he has taken up residency in my mother's home we cannot make him leave. We have to provide utilities and a bed for him. My nephew and his wife have been cleaning out the house and actually paid 1/2 of hotel accomodations for him during this period. Do I need to go through legal proceedings to evict him? If so I will need a lawyer in VA. I live in NH. I have contacted the diocese bishop but am told that the church cannot help me with this situation. I called this man to ask him what his intentions are. He was obviously flustered and said he couldn't talk at that time. I've tried to call him again and he has changed his cell phone #.

Yes, it does appear on these facts that you will have to go through formal eviction proceedings in order to oust this priestly occupant from your dwelling house in the Commonwealth.

Yes, you will need to commence legal action in Virginia. A letter to the priest from an attorney may help speed the process along. Otherwise, an attorney can help you with the eviction process. You may also wish to have an atttorney help with the sale of the house.
