Legal Question in Landlord & Tenant Law in Virginia

black mold

I found at least a 2x2 foot hole in the wall of my apartment on the first day of occupancy. In this hole and along the baseboard and carpet, there is a huge amount of black mold. I was not told anything about this whole before getting my key. There solution to this problem was to patch up the whole. The wet insulation is still there, along with the drywall that contains the mold. After one night there I was experiencing headache and nausea. i want the landlord to correctly fix the problem or give me my money back and cancel the lease. Help!

Re: black mold

Your landlord is not going to cancel your lease and refund whatever money you believe may be due you; he or she may, however, agree to allow you to move to a different unit without the mold problem if you make such a request.
