we are kicking our room mate out. is it legal to bag his belongings up and place them downstairs or outside. he is no longer on the lease and we dont want him in our home

While placing items of personal property "on the curb" is a common practice in an eviction, keep in mind that these evictions are the result of a judicial process and a court order of eviction to be conducted by the sheriff, who will be present. In your case you are simply putting your one-time friend's belongings on the curb and he may or may not recover them. If he doesn't recover them, you may be liable for the loss of his property.
