Legal Question in Landlord & Tenant Law in Virginia
I did a credit check and found out i owe 210,000 to a group i rented from over 10 years ago. There was a civil suit filed in 2006 i guess thats why it has just started appearing on my credit check recently. I was renting for around 600$ a month so this number seems alittle high to me even with interest. Also i stayed there until my lease was up then left as they had new managment and i felt the place wasnt being run very well.I had lived there about two years prev.My im biggest concern other than being 210,000 in debt over night is that i was married before i lived in the property and the civil suit happened after i was married can they lay clam to property? my wife owned before we were married or our income taxes that we file jointly we reley on our returns and put in extra to make sure we get a large return?I have no rent recipts as it was long time ago and I've moved several times since. Do i have any legal ground to stand on?Is there anything that this was something that happen so long ago?I really dont know what to do to fix this problem(besides going bankrupt and i dont know if that would fix anything anyways)

If you were never served with proper notice of the lawsuit that resulted in the judgment against you which has now apparently mushroomed to over over $200K, you should be able to file a motion pursuant to Va. Code Sec. 8.01-428 to have this judgment vacated or set aside. And, furthermore, any property owned by your wife prior to the marriage should be exempt from creditor attachment.
You would appear well advised to arrange for a consultation with a local attorney who handles landlord-tenant law or consumer affairs type matters and who should be able to further advise you on his particular matter.
