Legal Question in Landlord & Tenant Law in Virginia

My daughter moved to Alexandria to take a job. We allowed her to live with us until she was able to find an apartment of her own for her and our grandson. They were supposed to be living with us for a couple of months. It has turned into four months and seems like she has no intentions to move. She is not saving to move out and has a really bad attitude. She acts like my wife and I owe her something. She does not pay a dime of rent or help out around the house. We live in an apartment in Alexandria; she is not on the lease. She told us that we have to give her a thirty day notice before kicking her out. We provide free babysitting as well as free room and board and feel as if she is taken advantage of the situation. We would like to know what our rights are with respect to getting her out of our house. We don�t want to be hard hearted but we also do not want to be paying for her the rest of our lives.

Your rights are very likely the same as any other landlord's in the

Commonwealth, i.e., you have to go through the very same formal procedures involving the general district court to evict her, as any

other landlord would need to do, beginning with whatever advance notice

to your "tenant" that would be necessary under the facts described which likely would be the 30 days as has already been suggested.
