My daughter want to put her boyfriend out of her apartment which he is not on the lease. Does she have to give him notice or can she have the police remove him he refuses to leave.

No, your daughter very likely will have to comply with all the normal procedures which any landlord must comply with in filing a warrant for unlawful detainer in order to evict a tenant. (The clerk's office of her local general district court can further explain to her what that particular court may require in this regard.)
