Legal Question in Landlord & Tenant Law in Virginia
My elderly mother (Homeowner) let the son of a friend move in with her rent free until he got back on his feet. Fast forward more than 3 yrs and he is still there and has never paid rent(occasional grocery purchase) My mother recently told him he needs to move out and gave him a verbal two months notice. Can my brother and I basically put his belongings on the sidewalk if he refuses or do we have to go through a formal process? There is no lease agreement and never was. This man (39 yrs old) has basically been taking advantage of my mothers good nature and we need him gone. Thanks

Your mother (or you in her behalf) will have to follow the formal process
that would be necessary to evict a tenant (my opinion).
