Legal Question in Landlord & Tenant Law in Virginia
An elderly sickly woman would has been advised to have a person living with her in case of health emergency. She would like to offer no rental payment by tenant in exchange for their presence in her two bedroom, two bathroom apartment. The person is free to work a full time job outside of the apartment. Would a lease be in order for the person giving this service? Is this a legal arrangement in the state of Virginia ( and section 8 which is subsidizing the elders rental) and how do you document it best if a lease does not cover this?

Yes, this would obviously be a QUID PRO QUO arrangement which would need to be properly
memorialized in writing, spelling out the important terms of the agreement such as the number of hours and timeframe
when this "tenant" would be expected to be in this apartment and the manner/conditions under which the agreement
could be terminated by either party, etc.
Once the owner is clear as to what she expects of this prospective occupant, the services of an attorney, if at all possible,,should be engaged to draft the document which could then be further refined once the
owner has found somebody whom she believes she could work with in the arrangement that has been proposed (my opinion).
