Evict a Housemate

Currently, I am on a 1yr. lease with a housemate that expires Nov. 05'. My housemate has not paid 1/2 of the utilities last month. I paid the full amount due because the utilities are in my name only. I'm aware that I can sue in small claims court for monies owed, but can I ask her to leave the property eventhough she is on the lease? I want to remain at the property & will pay the rent in full.

Re: Evict a Housemate

You are not the owner of the property and are, therefore, not empowered to remove another co-signor of the lease from the subject property; only the owner or her designated agent, after finding the co-signor in material violation of the lease terms, would be entitled to have her removed from the premises.
