Legal Question in Landlord & Tenant Law in Virginia

My now ex fiancee and I have a two party check coming to us from the apartment complex we used to live in. She has had the check since September 9th and I didn't find out about it until September 25th and that was due to her slipping up and saying something to me about it while she was trying to avoid paying me the $1725 she still owes me. I told her that I wanted my half of the check and that I am pretty sure it was illeagal for her to be withholding it from me. She said that she wasn't going to let me have it. Then she made an excuse that my name was spelled wrong on the check, it was, and that she was going to turn it back into the leasing office to get a new one. Which has been done as well. So is what she doing illeagal and how can I get my money.

Sue her for your half in small claims court if she continues to "weasel"

regarding the matter.
