i gave a land lord 800 to hold a town home for me on the same day my father n law pass i ack if i could get it back i was told no is that legal i sill owe 350 plus 1150 before i can get the key move in date is feb 1

On these few paltry facts, it would be hard to say one way or the other (in my opinion). In other words, you simply haven't provided sufficient information for a determination on this issue, including whether you've already signed a binding lease agreement.
