Legal Question in Landlord & Tenant Law in Virginia
Harrasment by landlord
I rent a duplex apartment , which is owned by a man who lives in the upper level.I am on month to month occupancy.I have had no problems for the past 10 months.
I noticed some unusual behavior starting two weeks ago....have since found out he is bipolar and has stopped meds. he has made sexual suggestions and tried to come into my apartment constantly. I called the police and he agreed to go in for evaluation , then walked out of the hospital. He was then arrested outside the hospital for disorderly conduct and is still in jail. I want to move , but am afraid to disregard the 30 notice in our lease and lose my deposit and/or end up in court.
Please help............

Re: Harrasment by landlord
You can give the required 30 days notice and hope nothing further untoward happens or you can move immediatedly and argue that you were constructively evicted by the landlord's behaviour and are, therefore, entitled to the return of your deposit, although you may have to go to court to get it.
