Legal Question in Landlord & Tenant Law in Virginia
I have a home that I purchased two years ago in my name alone. My ex-husband (divorced in 2004) has lived with me for the past two years. I have recently (a month ago) asked him to leave. He refuses. He says that I can't force him to leave b/c he has bills listed to this location and because he has given me money towards bills for the past two years. I would like to know my legal rights and what steps I should take. There is no signed lease or any form of written agreement.

This would appear to be another situation where the person originally invited in to stay by the homeowner has now become "persona non grata" (no longer wanted)in the eyes of the homeowner and who must now initiate formal eviction proceedings in the local general district court in order to get the person out.
If this in fact describes your particular situation, your next step should be a visit to the clerk's office (civil division) of your general district court to start filling out the paperwork to initiate the eviction process.
