Can a commercial landlord evict a tenant without written notice eventhough they were late on the rent? There is no active lease, the term is month to month.

The lease is likely an oral, month to month version of the written agreement which was previously in place, and which very likely gives the landlord the authority to do what you've described. (But you might want to scrutinize this written lease just to make sure.)
