Legal Question in Landlord & Tenant Law in Virginia
My landlord is taking my roommates and I too court to paid back rent. We only have one roommate that hasn't been paying his rent for 6 months. He never kicked him out, he told us that we could if we wanted to. The roommate that hasn't been paying rent is the only one that is not being taken to court by our landlord also. Is there anything any of us can do to not have to cover our other roommate?

Once the landlord recovers a judgment against the two of you for the unpaid rent,
then either or both of you could sue this free-loading roommate in small claims court for the amount of the judgment plus costs.
