Legal Question in Landlord & Tenant Law in Virginia

Landlord's Statement to Release Me From Lease Obligation

I need to relocate to SC to live with an elderly parent. Lease is up the end of July. I've notified of my intent to leave by June 30, if I can find a renter. I've found a renter who is approved to sign lease for July, but landlord won't provde a statement that I'm released for payment for July. All I have is letter from her that my lease is current until July 31, or until the apartment is occupied, whichever comes first. How can I avoid future claims? She says by law she can't accept rent from two people on the same apartment for the same month so I don't need a statement.

Re: Landlord's Statement to Release Me From Lease Obligation

It would seem that you could accept the July rental payment from your substitute renter and allow him or her to occupy the premises as of July 1, 2007(assuming there is no prohibition on such subtenancy).

You would then deposit the renter's check in your account and write your own check to the landlord for the July rent with another notice of your intent not to renew the lease upon its expiration at the end of July 2007.

This should free you of any further obligation with respect to the lease and allow you to proceed with your plans to relocate to South Carolina.
