Lawsuit for damages and late rent fees

My wife and I live in New york State and my former landlord who lives in Virginia is trying to sue us for bogus damages and late fees. We moved out in 8/29/2008 and he just sent us a notice on 10/16/2008 to pay up within 30 days or he will file a lawsuit against us for $2316. No damages were done to the house and even though we paid late he accepted the late checks without incurring us late fees. Now he wants to add on those fees and he has not returned our security deposit. what can I do?

The landlord can likely still make a viable claim for the late fees. You may wish to send a written response to this letter offering a settlement of some sort which could include these late fees but not necessarily the other damages with which you do not agree or which you dispute.
