Legal Question in Landlord & Tenant Law in Virginia

No Lease Terms

My landlords offered to give me a place to live when I was having financial difficulties. They would give me time to get my feet on the ground, but ''at some point I would need to sign a lease''. I have not been asked to sign a lease and have been here 27 months.

They sent me a letter asking me to vacate the premises or they would seek judgement for past rent. I have received a notice to appear in court and either pay the amount past due or they will take possession of the property and its contents.

The summons states that I am to repay the rents as defined in the ''written agreement''. If there never has been such a document, can a judgement be granted?

Re: No Lease Terms

Only if your landlord can prove that there was some kind of agreement for your lease of the premises.(Irrespective of that, however, you will still very likely be ordered evicted and the landlord granted possession.)
