Legal Question in Landlord & Tenant Law in Virginia

I live in a high rise building in Arlington and pay around 120 a month for parking in their private garage. On 8/12/16, I came back to Virginia from Philly, and couldn't find my vehicle. As an aside, I work as an Analyst and travel every week to Philadelphia and usually stay over the weekend)...When I couldn't find my vehicle, I asked the concierge. They told me it probable was towed. I call the towing company, and they said they have my vehicle, that I was "double-parked", and I owe 710 dollars (160 for the initial tow and 50 a day for storage).

I contact my apt complex asking me why I wasn't notified. Their response was that the towing company usually takes pictures of the car and plate, and sends them to my apt complex. In this instance they did not.

My lease agreement says they tow "without warning." I said that makes sense and I'm not disputing whether I was double-parked or not, but the fact that I live in a luxury high rise, pay 120 for my vehicle in their private garage, and wasn't even notified that I was towed.

My question is if I have a small claims court case? I don't know what to do...

Yes, you could sue the tow company for your damages in small

claims court if it towed your vehicle without adhering to the

required procedures which should include taking pictures of

the vehicle and its plate to prove that you were in violation of

the building's parking rules and that the tow was therefore permissible.
