Legal Question in Landlord & Tenant Law in Virginia

We live in Richmond, VA. My daughter signed a lease agreement to rent room in the house starting May 1st 2012 with, as we thought, owner of the house. Deposit of $650 was paid. On June 25th tree fell into house and she had to move out that day. And then we found out woman is not owner, she is renter and owners did not know about the situation. Now so called landlord is saying she has 45 days to pay deposit and prorated rent back. Our daughter needs to rent a place asap and pay new deposit. Lease agreement they signed says: � This lease is not governed by the Virginia residential landlord and tenant act(section 55-248.2 et seq. Virginia Code)�. What are my daughter�s rights in all this situation. Thank you.

If this tenant attempted to sublease this property to your daughter without the

true owner's permission, then this lease is likely void and unenforceable and

your daughter should likely be demanding the return of her security deposit and

looking for another place to live.
