Legal Question in Landlord & Tenant Law in Virginia

non refundable security deposit

I paid $800 dollars for an apartment to hold a unit for me. I was supposed to move in at the end of Nov. but my husband is overseas and did not want me moving into a new apartment. I let the owners know at the beginning of Nov. that I would not be moving in. Now they wont give me my sec deposit back and I didn't even sign a lease! Can I do anything about that or am I just gonna be out $800??

Re: non refundable security deposit

Whatever kind of commitment you may have made that was apparently something other than a signed lease, a penalty of $800 imposed for changing your mind seems exorbitant, and, if after making written demand for the return of these funds(minus, perhaps, a modest application fee), the landlord refuses to refund your deposit, you should file suit in small claims court.
